- "This site" refers to the website (https://kiiks.online/) that provides this service.
- Unless otherwise specified in this agreement, all dates and times shall be in Japan time.
- In this agreement, the headings in each section are for convenience and shall not affect the interpretation of this agreement.
- Citation of clause shall refer to the clause of this agreement unless otherwise stated.
Article 2 (Scope of Application and Changes)
- Users shall comply with these terms and conditions when using the shop.
- Individual provisions and additional provisions that we separately post on the web page on this site shall constitute a part of these provisions. If these individual rules or additional rules differ from these terms, the individual rules or additional rules shall prevail.
- In the event that The Company meets any of the following conditions, The Company reserves the right to modify this agreement, individual provisions, and additional provisions:
- When the modifications to this agreement, individual provisions, or additional provisions are in the best interest of the users in general.
- When the modifications to this agreement, individual provisions, or additional provisions do not go against the purpose of the sales contract, and are reasonable in terms of the necessity of the modifications, the adequacy of the modified content, and other circumstances related to the modifications.
- In the event that The Company modifies this agreement, individual provisions, or additional provisions based on the preceding clause, The Company will notify the users of the modification, the content of the modification, the effective date, and other relevant information by posting it on a web page on this site.
Article 3 (Shop Function)
- The functions of the shop that we provide for users are as follows:
- A function to provide information on items sold by the seller in an online electronic catalog.
- With regard to user order information, we accept orders for items received by our computer system that manages and operates the shop.
- The Company shall be able to add or delete the contents of the service functions at any time by notifying the user, and shall not be liable for any damages caused to the member by such addition or deletion.
- Users shall solely use the shop for non-commercial purposes and shall not engage in any business activities using the service, use the service for their own business purposes, or engage in any other commercial activities using the service.
Article 4 (Product Order)
After selecting the product, you will be asked to enter the information required to order and deliver the product, such as the shipping address and payment method. (Membership registration is not mandatory.)
When your order is complete, you will receive a confirmation email confirming your entry and your order details. We are not responsible for any damages caused to customers due to failure to receive e-mail from our store.
Article 5 (Product Delivery)
The items ordered will usually be shipped within three business days.
* Email will be sent to you when we have shipped the item. However, please understand that when we have a lot of shipping items, we may be able to send such email only later or may not be able to send such email at all.
* For reserved items, the estimated shipping date is listed for each item.
Article 6 (Payment)
Payment can be made by credit card (VISA, MASTER, JCB, AMEX), Amazon Pay, Apple Pay, Google Pay, PayPal, Shop Pay, Deferred payment (Paidy), and Mobile payment (PayPay).
Article 7 (Return/Exchange of Items)
The Company will only accept returns and provide exchanges for products that were delivered as defective. In such cases, The Company will cover the shipping costs for the return and replacement.
Article 8 (Product Cancellation)
The order cannot be canceled after the product is shipped.
Article 9 (Member Registration)
A person who wishes to register as a member (hereinafter referred to as “applicant for membership”) shall apply for membership in accordance with the procedures set forth below and other procedures established by the Company.
- It is necessary to read this agreement carefully, understand its contents, and agree to comply with it. Applicants are deemed to have agreed to abide by the terms of this agreement as a result of clicking on the “Register Membership” button on the shop web page.
- Enter all necessary information (hereinafter referred to as “Registration Items”) specified by the Company on the registration screen as necessary for membership registration, such as name, address, phone number, e-mail address, password, etc. The Company will not be held liable for any disadvantage experienced by applicants due to incorrect or incomplete input.
Article 10 (Changes in Notification Items, etc.)
- Member shall notify the Company by means of its designated form without delay.
- If the notification from the Company is not reached due to failure of the notification in the preceding paragraph, the notification shall be deemed to have arrived when it should normally be reached.
Article 11 (Handling of Personal Information)
Information registered by the user when using the service and the subsequent information notified to the Company (hereinafter referred to as “personal information”) shall be handled appropriately by the Company in accordance with “Handling of Personal Information” posted separately on this site.
Article 12 (Prohibited Matters)
- Users shall not perform acts specified as follows when using the shop:
- Acts of entering false content or of impersonating someone
- Acts that infringe or may infringe on copyrights, trademarks, or other rights of our company or third parties
- Acts of ordering products etc. without intention of purchasing them
- Delaying payment obligations
- Interfering with shop operations
- Acts of publishing or posting on the shop information that is offensive to public order and morals (including but not limited to obscene or violent messages, graphics, audio, etc.)
- Other acts that the Company deems inappropriate
- The user who violates the preceding clause shall be held responsible for the consequences of such violation, and The Company shall not be held liable. However, this shall not apply if The Company is found to be intentionally or negligently at fault.
Article 13 (Suspension and Cancellation of Membership)
If a member falls under any of the following clauses, the Company shall be able to suspend or cancel the membership without any notice or demand.
- When the password was used illegally or when a third party was allowed to use it
- When the member obstructed the operation of the shop by any means
- In case of violation of any provision of these Terms
- In case of not paying the due amount for the products purchased using the shop by the due date and of not fulfilling other obligations incurred in relation to the use of the shop by the due date
- Other instances where the Company decides that a member is not qualified
Article 14 (Shop Operation Suspension)
- The Company may suspend or abolish part or all of the operation and provision of the shop without notifying the user in advance if there is a reason specified in any of the following clauses:
- When the maintenance inspection or update of the equipment or system for the operation and provision of the shop is performed regularly or urgently
- When it is difficult for the operation and provision of the shop due to war, terrorism, riot, disturbance, labor dispute, earthquake, eruption, flood, tsunami, fire, power outage, or other force majeure
- When the services of the telecommunications carrier are not provided
- In addition, when it is necessary to suspend or stop the operation or provision of the shop for operational or technical reasons, or when it is difficult for the Company to continue in the operation and provision of the shop due to unforeseen circumstances
- The Company shall not be liable for any disadvantages or damages incurred by users or third parties due to temporary interruption or suspension of shop operation and provision, regardless of the reason. However, this shall not apply if The Company is found to be intentionally or negligently at fault.
Article 15 (Scope of Liability)
In the event that a customer incurs any form of damage (regardless of whether it is indirect or direct) as a result of using the shop or the products and services provided by the shop, The Company shall not assume any responsibility for damages or compensation.
Article 16 (Damage Compensation)
If the user causes damage to a third party by using the shop, the user will solve the matter on his/her own responsibility and at his/her own expense and will not cause damage to the Company. If a user causes damage to the Company by violating the Terms, the Company can claim damages against the user.
Article 17 (Effectiveness and Individuality of These Terms)
If any provision of these Terms is invalid or illegal, the other provisions of these Terms will remain valid without any effect.
Article 18 (Governing Law)
The governing law of this agreement shall be Japanese law.
Article 19 (Agreed Jurisdiction)
Regarding any lawsuits related to the use of the shop or these terms and conditions, the district court with jurisdiction over The Company's main office location shall be the exclusive agreed jurisdiction court of first instance.
